WARRANTY: Omega-Trim™ vinyl trim products are warranted by Omega-Tek Building Products, Inc. ("Omega-Tek") at the time of delivery to be free from defects in material and workmanship for the life of the products under the terms and conditions set forth below.

What is the scope of the Warranty?

Omega-Tek warrants to the owner of the property at the time the products are delivered that the products, as manufactured and delivered by Omega-Tek and under normal installation, use and conditions, will not blister, peel, splinter, pit, corrode, crack, check, warp, cup, rot or suffer termite damage or fungal decay.

What is the term of the Warranty?

The Lifetime Limited Warranty continues for the life of the products as long as the owner of the property at the time of installation continues to own the property. The Warranty cannot be transferred to a subsequent owner of the property or other party. In the case of an owner that is a business, association, school, government or otherwise other than an individual, the warranty shall expire 30 years after purchase and delivery of the products.

What is not covered by the Warranty?

The Warranty does not cover defects or damage attributable to:

• improper installation
• use of the products for other than residential (single or multiple residence) applications or for a use for which it was not intended or that is not permitted under applicable building and safety codes
• movement, settling or change in the ground or structure supporting the products
• naturally occurring casualties such as earthquakes, floods, rain, tornadoes, wind, hail, lightning and other acts of God
• misuse or abuse of, or modifications to, the products by parties other than Omega-Tek
• fading, staining or other damage caused by exposure to the elements, air pollutants, vapors, fumes, mold or mildew
• fire or exposure to excessive heat sources such as barbecue grills or reflective surfaces
• If painted, Omega-Tek will not cover the paint performance as it pertains to fading, cracking, peeling, adhesion, chalking and any other paint related problem. Painting the product a color darker than the published LRV of 55 will void any warranty on the Omega-Trim™
• use of improper cleaning compounds, pesticides, paints, surface treatments or other chemical substances on the products
• foreign objects that strike the products
• Installer must carefully examine each piece of Omega-Trim™ before installation and not install pieces with defects. Omega-Tek will not be held responsible for material or labor on material that has been installed that has what a reasonable person would consider to be an obvious defect (stains, scratches, extrusion lines, color, size and shape variations, or other defects)
• any other cause beyond the control of Omega-Tek

How do I make a claim under the Warranty?

Should your Omega-Trim™ products show a covered defect at any time, you must promptly notify Omega-Tek in writing after discovering the claimed defect and prior to attempting any repair.

The notice must include a detailed description of the claimed defect, the location of the installation, the date the condition was discovered, one or more photographs of the condition, proof-of-purchase if your Warranty has not been registered, and your name, address and phone number. The notice should be mailed, postage prepaid, to Omega-Tek Building Products, Inc., Warranty Claim, PO Box 635, West Swanzey, NH 03469.

Upon receipt of the claim, we will investigate and validate it. If we require any additional information, we will contact you at the address or phone number provided by you. Any attempted repair of the claimed defect without prior written authorization from Omega-Tek will void this Warranty.

What are my remedies in the event of a valid claim?

If it is determined that a defect exists under the terms of this Warranty, your sole remedy, at the election of Omega-Tek, will be the repair, painting or replacement of the defective products at Omega-Tek's cost or the refund of the original purchase price of such products. If the defective product is replaced, replacement material of as close a color, design and quality as possible will be used but we do not guarantee an exact match. Repairs and replacements will be made within a reasonable time after the claim is received and verified, either by Omega-Tek or a qualified subcontractor chosen by Omega-Tek. After repair or replacement, the Warranty will extend only for the time remaining under the original Warranty. In no event shall the total of all claims submitted under this Warranty exceed the total purchase price paid to Omega-Tek for the Omega-Trim™ products.

Limitations on Warranty

OMEGA-TEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LABOR COSTS AND OTHER EXPENSES FOR THE INSTALLATION AND REMOVAL OF THE ORIGINAL VINYL TRIM AND INSTALLATION OF THE REPLACEMENT PRODUCTS, RESULTING FROM ANY BREACH OF ANY APPLICABLE WARRANTY, EXPRESS OR IMPLIED, OR ANY CLAIM UNDER CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHERWISE, RELATED TO Omega-Trim™ PRODUCTS. Some states do not allow the exclusion or limitation of incidental or consequential damages, in which event such limitations would not apply to you.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES AND REPRESENTATIONS WHATSOEVER, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow the exclusion of, or limitations on the length of, implied warranties, in which event the above limitation may not apply to you.
